After losing control of the brand "iPhone" in Brazil last February, Apple is on the verge of signing an agreement with the company Gradiente Eletronica which owns the brand in the country. Apple's iPhone could therefore coexist with another terminal of the same name in Brazil.
In February, the Institute of Intellectual Property Brazil vindicated the firm Gradiente Eletronica regarding the possession of the trademark "iPhone" in the country: the Brazilian company had filed the term in 2000, seven years before the release of Apple terminal and markets since December an Android smartphone christened. However, the situation in the state does not mean Apple should immediately rename the handsets sold in Brazil: the decision amounted to Gradiente Eletronica on this point.
And not surprisingly, Apple did not wait to look for a settlement with the Brazilian company: quoting a Brazilian newspaper, Forbes says that the two companies would be close to find an arrangement that would allow Apple can always use the name "iPhone" in Brazil. For now, any legal proceedings would be frozen pending the completion of negotiations.
The information gathered by the newspaper Folha de Sao Paulo from an anonymous source close to the case does not indicate the amount of money that Apple could put on the table to retain the right to use the trademark "iPhone" in Brazil: neither company has to comment on the information.
